The ordinance now increases license fees, effective June 1 for new businesses and Jan. 1 for old ones; requires massage therapists to have photo identification, proof of state certification and to submit to fingerprinting; limits the number of massage therapy businesses to three per 10,000 residents; and removes conditional-use permits.

Businesses currently operating in Duluth will be grandfathered into the new law and allowed to remain open until they change owners or commit a violation. Duluth has eight massage parlors, with six located along Peachtree Industrial.

The city council in Duluth has approved an amendment aimed at tightening restrictions on massage parlors in the city.
The Gwinnett Daily Post reports (http://bit.ly/KYaq93) the ordinance passed Monday limits the number of massage parlors allowed within the city and requires more stringent background checks for applicants and managers.It also requires therapists at businesses to submit to fingerprinting at the request of city officials to verify their identity and state certification.The new ordinance also increases the licensing fee for such businesses from $500 to $1,500.City officials say they have concerns that some massage parlors have led to an increase in crime in Duluth, an Atlanta suburb just northeast of the city.___Information from: Gwinnett Daily Post, http://www.gwinnettdailypost.com

The changes represent the city’s attempt to stop the proliferation of massage parlors, crack down on unlicensed massage therapists, and control prostitution.
Duluth Planning Director Glenn Coyne provided research to the council that supported limiting the number of massage businesses to three per 10,000 population in the city for a total of seven instead of the four per 10,000 or 10 total considered last week.
Massage businesses will only be allowed to locate in C-2 (commercial) districts. Also, a 150-foot buffer from residential areas will be required.
Duluth Police Det. Rick Thompson told the council that the photo ID requirements and fingerprinting would make it easier to identify unlicensed therapists. If identities can’t be verified, police would be allowed to fingerprint therapists to compare with applications on file.

Thompson said that prostitutes often use massage parlors as a base of operation. They tell their customers to meet them in the parking lot, he said.

Duluth wants to crack down on illegal massage parlor activity
DULUTH, Ga. —
The Duluth City Council is considering amending the ordinance that regulates massage businesses.
Supporters said the changes are necessary to curb things like prostitution and child sex trafficking.
Chip Sweney is the assistant pastor at Perimeter Church and a member of Street Grace, an organization aimed at stopping commercial sexual exploitation of children.
“It is going on and it is going on even with girls who are under the age, under 17 years old,” Sweney told Channel 2’s Amy Napier Viteri. “Even women who are friends who go into an establishment and the establishment will say this isn’t for you. In other words this isn’t for women.”
Sweney said he believes some Duluth massage businesses contribute to the problem and that the proposed changes would improve things.

As of Monday, the Cruchelow Jewelry & Loan website maintained the word “loan” in the store’s name. It was also on signs at its location at 2953 N. Cobb Parkway.
Mathews said the City Manager Steve Kennedy’s office was reviewing whether anyone should be held responsible for the licensing foul-up.
“It’s purely within his abilities,” Mathews said.
In 2004, the city’s approval of a zoning request for Venturi put in writing that the Mack Dobbs Point shopping center would be free from certain kinds of business — including pawnshops.
After neighbors expressed concern about the strip mall during the initial zoning process, an agreement was reached that restricted what could be put at the strip mall. Among the other uses prohibited at the site, which were written into city ordinances, were adult bookstores and massage parlors.

Meetings were organized with developer Celestino Venturi by nearby residents to stop the rezoning, but an agreement was eventually reached with city officials to prohibit certain types of businesses in the new development, such as adult bookstores, massage parlors and pawnshops.
“Residents concerns were at that point more towards just what would go on that parcel, which was next to the northern end of our development,” Harris wrote. “We had expressed our opinions to Mr. Venturi and some of us attended the October 4, 2004, Kennesaw City Council meeting where quite a lot of time was devoted to the zoning change. In fact, of the 33 pages of minutes of that meeting, 14 pages had to do with the zoning change.

“The worst answer for area residents is if they just give them a variance and allow them to remain,” Harris said. “The next business that wants to locate there and is blocked from doing it would then be able to say, correctly, ‘Well you gave them a variance to remain, and we want one also.’ So perhaps we end up with some adult book store or massage parlor because the city decided to let this pawn shop slide.”

An undercover police officer from the Bronx Vice Squad visited the massage parlor, at 4685 Manhattan College Parkway, on Feb. 29 at about 3:40 p.m. He received a 30-minute-long massage from Ying Al Li, 43, and inquired about sexual services afterward, according to a complaint filed with the Bronx District Attorney’s office.

Undercover investigators first struck New Healing Touch on Dec. 22. A different undercover officer visited the massage parlor and after employee Yingji Li allegedly offered to touch his penis in exchange for money, she was arrested and charged with one misdemeanor prostitution count. Yingji Li’s arrest came less than three weeks after state Sen. Jeff Klein sent a letter to Police Commissioner Ray Kelly requesting that the NYPD look into possible prostitution at New Healing Touch.

“I requested that they go back, because I was looking for the nuisance to be abated,” Capt. Burke said, adding that he referred the massage parlor to the NYPD’s Nuisance Abatement legal arm.

Other items of business at the meeting included a report by Kennesaw Youth Council vice-chair Rebecca Fant, who said the council will be sponsoring an effort to donate old tennis shoes at Kennesaw Mountain, North Cobb and Harrison high schools. The shoes will then be turned into rubber chips by Georgia Tech students and eventually used at area playgrounds as ground cover.
The only public comment of the evening came from licensed massage therapist Rebekah Wright, who owns Wright Touch Natural Health at 3745 Cherokee Street in Kennesaw. Wright took exception to wording in an amendment regarding massage businesses’ responsibilities in applying for business licenses with the city.
“I appreciate being notified of this meeting, but the language they use is very patronizing,” said Wright. “And calling us massage parlors? Really?”

Atlanta Massage Parlors: Alpharetta mulls changes downtown

ALPHARETTA, GA. Alpharetta is pondering some changes to its Uniform Development Code that would improve the aesthetics of the downtown and make it more attractive to new businesses. And one ordinance is designed to enforce creativity.
At its Feb. 28 workshop, the City Council discussed three ordinance changes that aimed at sprucing up the city’s historic downtown area. Perhaps the most controversial one seeks to limit the number of thrift shops in the district.
At the workshop, Community Development Director Diana Wheeler said a draft ordinance suggests a limit of 5,000 feet separate future thrift shops and consignment stores excluding antique stores which would encourage more retail stores in the district.
Many types of uses are regulated by distance requirements such as massage parlors and package stores. The proposed ordinance would make thrift stores a conditional use in all commercial zoning categories, which would mean council would have to approve each one.
