At McDuffie’s preliminary hearing in DeKalb County Magistrate Court on Tuesday, witnesses made it clear that McDuffie didn’t match the description of the suspects, said her attorney, Max Hirsh of Decatur.
“They said it was four men, and Destiny is clearly a woman,” he said. “She never should have been arrested.”
The shooting happened around 3:45 a.m. on March 7 in the parking lot of the Creekside Corner Apartments in the 6300 block of Turnberry Place.
The cases against two of the other suspects — Marquette Mackie and Jacques Thornton — were bound over to Superior Court at Wednesday’s hearing. The fourth suspect, Sentelle Williams, is still awaiting a preliminary hearing.
Police have said the shooting stemmed from an argument at a strip club earlier that evening. The people in the fight all knew each other, investigators said.
