Law enforcement is pretty much the boogeyman of the sex trade for those of us who aren’t criminally insane and just want to pay for some quick, convenient sex. The entire business is mired in its share of problems but if you’re a normal person, the escort is a normal person, no one’s secretly fronting for a massive drug cartel or running guns or anything of that nature then by and large the only thing we need to fear, beyond disease (and of course everyone should be about safe sex) is law enforcement. And probably there’s a bit of a thrill in shirking the law like that, even for a crime that’s not actually hurting anyone (numerous conservative arguments to the contrary aside).
Because of this, it’s with a small amount of amusement that you read a story like this one; an appeals court in Minnesota just handed a Minneapolis cop his ass for going a bit above and beyond in a prostitution sting, overturning the misdemeanor conviction of a girl working a massage parlor. The reason? The cop started it.
People toss the word entrapment around a lot, particularly when caught in a corner, but the fact is police are allowed to use a lot of deception and subterfuge to catch criminals. And that’s necessary and a good thing, it keeps a lot of dangerous buggers off the streets. But when it comes down to prostitution, the rules say it’s kosher if she starts doing her thing. Not if a male cop starts doing his.
In this case, the cop initiated contact at what was otherwise a non sexual massage. He started fondling her breasts and when she started going along with it, then she was arrested. The lesson here? That is not legal. Not by a longshot.
The judge in the case said the officer’s conduct was “outrageous” and “repugnant to the criminal justice system,” pretty harsh words for a tit fondler.
