A portion of a bill penalizing pimps and johns for human trafficking may be unconstitutional and jeopardize the entire bill.
If you’re accused of coercing someone into prostitution, the bill, as written, tells you want you can’t use as a defense. That list includes the sexual history of the victim. That’s unconstitutional according to Jack Martin of the Georgia Association of Criminal Defense Lawyers.
“If the person who claims to be a victim had previously been a prostitute, it would at least be relevant to show the jury that she wasn’t coerced into this,” said Martin. “She had always done this in the past.”
However, Sherry Senterfitt, the legislative counsel for Georgia Women For A Change, argues the provision in question is no different than Georgia’s rape shield law.
